    This Privacy Policy describes how The Vice Solution, LLC ("The Vice Solution," "we," "us," or "our"), a Florida limited liability company located in Lake Wales, Florida, collects, uses, shares, and protects information about you when you visit thevicesolution.com and any related subdomains, pages, or services we operate (collectively, the "Site"), submit a contact or project inquiry, subscribe to our newsletter, purchase services, or access a client portal or account (collectively, the "Services").

    By using the Site or Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site or Services.

    1. Who We Are and How to Contact Us

    The Vice Solution, LLC is the "controller" of personal information collected through the Site, which means we determine how and why your information is processed.

    2. Information We Collect

    We collect information in three ways: (a) information you provide directly to us, (b) information collected automatically when you use the Site, and (c) information we receive from third parties.

    2.1 Information You Provide Directly

    • Contact and project inquiry information. When you submit a contact form, request a quote, or book a consultation, we collect your name, email address, phone number, business name, project details, budget, and any other information you choose to share.
    • Newsletter and marketing list information. When you subscribe to our email list, we collect your name and email address. You can unsubscribe at any time using the link in any email.
    • Account and client portal information. If you create a client account, we collect your name, email address, password (stored hashed), business information, billing contact, and any files, messages, or assets you upload.
    • Payment information. When you purchase services, our payment processor (Stripe, PayPal, or a similar provider) collects your name, billing address, and payment card or bank information. We do not store full payment card numbers on our servers. We receive limited transaction information (last 4 digits, card brand, transaction status) for our records.
    • Communications. If you email, call, or message us, we keep a record of that communication, including the content, date, and any files you send.

    2.2 Information Collected Automatically

    When you visit the Site, we and our third-party tools automatically collect:

    • Device and connection data: IP address, browser type and version, operating system, device type, screen size, referring URL, and language preference.
    • Usage data: Pages viewed, links clicked, time on page, scroll depth, navigation paths, search terms entered on the Site, and session duration.
    • Cookies and similar technologies: See Section 5 below.
    • Location data: Approximate location inferred from your IP address (typically city or region, not precise geolocation).

    2.3 Information from Third Parties

    We may receive information about you from:

    • Analytics providers (such as Google Analytics) that report aggregate and individual visitor behavior.
    • Advertising platforms (such as Meta, TikTok, Google Ads) that report on the performance of ads we run.
    • Service providers that help us operate the business (email, CRM, project management, hosting).
    • Publicly available sources (such as your business website, LinkedIn profile, or Google Business listing) when researching prospective clients.

    3. How We Use Your Information

    We use the information we collect to:

    • Respond to inquiries, provide quotes, schedule consultations, and onboard new clients.
    • Deliver, support, and improve the Services, including design, development, hosting, and AI consulting work.
    • Process payments and send invoices, receipts, and billing notices.
    • Operate and secure client accounts and the client portal.
    • Send transactional communications (project updates, account notices, deliverables, support replies).
    • Send marketing communications (newsletter, case studies, offers) — only with your consent where required by law, and always with an easy unsubscribe option.
    • Measure and analyze how the Site performs, what content resonates, and how to improve user experience.
    • Run, measure, and optimize advertising campaigns on third-party platforms.
    • Detect, prevent, and respond to fraud, abuse, security incidents, and violations of our Terms of Service.
    • Comply with legal obligations, enforce our agreements, and protect our rights and the rights of others.

    4. Legal Bases for Processing (EEA / UK Visitors)

    If you are located in the European Economic Area, the United Kingdom, or Switzerland, we rely on the following legal bases under the GDPR / UK GDPR:

    • Contract: To provide Services you have requested, manage your client account, deliver project work, and process payments.
    • Consent: For marketing emails, non-essential cookies, and ad pixels (where required). You may withdraw consent at any time.
    • Legitimate interests: To operate and improve the Site, secure our systems, prevent fraud, analyze usage, and pursue and retain clients — balanced against your rights and freedoms.
    • Legal obligation: To comply with tax, accounting, anti-fraud, and other applicable laws.

    5. Cookies, Pixels, and Tracking Technologies

    We and our third-party providers use cookies, web beacons, pixels, local storage, and similar technologies to operate the Site, remember your preferences, measure performance, and serve relevant advertising. The categories include:

    • Strictly necessary — required for the Site to function (e.g., session management, security, load balancing). These cannot be disabled.
    • Performance and analytics — including Google Analytics (GA4) and similar tools, which help us understand how visitors use the Site.
    • Advertising and retargeting — including the Meta (Facebook) Pixel, TikTok Pixel, Google Ads conversion tags, and similar tools, which help us measure ad performance and show relevant ads to visitors on other sites.
    • Functional — remember preferences like form fields, language, or last-viewed pages.

    Where required by law (including in the EEA, UK, and California), we present a cookie consent banner the first time you visit. You can change your choices at any time by clicking the "Cookie Preferences" link in the Site footer.

    6. How We Share Your Information

    We do not sell your personal information for money. We share information only as described below:

    • Service providers and processors that help us operate the business, including: hosting (e.g., Vercel, Hostinger, Coolify VPS), email and marketing (e.g., ConvertKit, Mailchimp, Beehiiv, Google Workspace), CRM and forms, project management, file storage, analytics (Google Analytics), advertising platforms (Meta, TikTok, Google), payment processing (Stripe, PayPal), and automation (Zapier and similar). These providers may access your information only to perform services for us and are contractually required to protect it.
    • Professional advisors such as our accountants, attorneys, and insurers when reasonably necessary.
    • Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any material change in ownership or use of your information.
    • Legal and safety. We may disclose information to comply with applicable law, valid legal process, government requests, or to enforce our agreements, protect our rights, or address fraud, security, or safety issues.
    • With your consent. For any purpose disclosed to you at the time, with your permission.

    "Sale" or "Sharing" Under California Law

    Under the California Consumer Privacy Act (CCPA/CPRA), the use of certain advertising pixels and cookies may be considered a "sale" or "sharing" of personal information for cross-context behavioral advertising. You have the right to opt out — see Section 11 below.

    7. Payment Processing

    Payments are processed by third-party payment providers (such as Stripe and PayPal). When you make a payment, your payment information is collected and processed directly by the provider in accordance with their privacy policy. We receive only limited transaction data necessary to fulfill the order, issue receipts, and maintain financial records. We do not store full payment card numbers.

    8. Data Retention

    We retain personal information for as long as is necessary for the purposes described in this Policy, including:

    • Contact and inquiry data: Up to 24 months after the last interaction, unless you become a client.
    • Client account and project records: For the duration of the engagement and up to 7 years afterward for tax, accounting, and dispute-resolution purposes.
    • Newsletter subscribers: Until you unsubscribe, plus a short suppression-list retention so we do not re-add you accidentally.
    • Analytics and log data: Typically up to 26 months for analytics; up to 12 months for server and security logs.
    • Backups: Backups may persist for up to 90 days beyond active deletion before being overwritten.

    We may retain information longer when required by law, to resolve disputes, or to enforce our agreements.

    9. International Data Transfers

    The Vice Solution is based in the United States. If you access the Site from outside the U.S., your information will be transferred to, processed, and stored in the U.S. and other countries where our service providers operate. These countries may have data-protection laws that differ from your jurisdiction.

    Where we transfer personal data of EEA, UK, or Swiss residents outside their region, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (SCCs) or equivalent mechanisms.

    10. Security

    We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. These include encryption in transit (HTTPS/TLS), access controls, hashed passwords, principle-of-least-privilege for staff and contractors, and regular review of our systems.

    No method of transmission or storage is 100% secure. We cannot guarantee absolute security and you use the Site at your own risk. If we become aware of a personal data breach affecting you, we will notify you as required by applicable law.

    11. Your Privacy Rights

    Depending on where you live, you may have the following rights regarding your personal information:

    11.1 General Rights (All Users)

    • Access — Request a copy of the personal information we hold about you.
    • Correction — Ask us to fix inaccurate or incomplete information.
    • Deletion — Ask us to delete your personal information, subject to legal and contractual exceptions.
    • Unsubscribe — Opt out of marketing emails using the unsubscribe link in any email.
    • Cookie controls — Change your cookie preferences using the "Cookie Preferences" link in the Site footer or your browser settings.

    11.2 European Economic Area, United Kingdom, and Switzerland (GDPR / UK GDPR)

    If you are in the EEA, UK, or Switzerland, you also have the right to:

    • Restrict or object to certain processing of your personal data, including direct marketing.
    • Data portability — Receive your data in a structured, commonly used, machine-readable format.
    • Withdraw consent at any time where we rely on consent (this does not affect prior lawful processing).
    • Lodge a complaint with your local data-protection supervisory authority. A list of EU authorities is available at https://edpb.europa.eu/about-edpb/board/members_en. UK residents may contact the Information Commissioner's Office at https://ico.org.uk.

    11.3 California Residents (CCPA / CPRA)

    If you are a California resident, you have the right to:

    • Know what categories and specific pieces of personal information we collect, use, disclose, sell, or share about you.
    • Delete personal information we have collected from you, subject to certain exceptions.
    • Correct inaccurate personal information.
    • Opt out of "sale" and "sharing" of your personal information for cross-context behavioral advertising. You can submit a request by emailing privacy@thevicesolution.com or by enabling the Global Privacy Control (GPC) signal in your browser, which we honor.
    • Limit use of sensitive personal information (we do not knowingly collect sensitive personal information for purposes that would require this opt-out).
    • Non-discrimination for exercising your rights — we will not deny you Services, charge you a different price, or provide a different level of quality because you exercised a CCPA right.

    Categories of personal information collected in the past 12 months (per CCPA Section 1798.140): identifiers; commercial information; internet/network activity; geolocation (general); professional/employment information; inferences drawn from the above.

    Categories sold or shared: internet/network activity and identifiers, in the context of advertising pixels (as defined under CCPA).

    Categories disclosed for a business purpose: all of the above, to the service-provider categories listed in Section 6.

    To submit a verifiable consumer request, email privacy@thevicesolution.com with the subject line "California Privacy Request" and include enough information for us to verify your identity. You may also designate an authorized agent to make a request on your behalf, subject to verification.

    11.4 Other U.S. States

    Residents of states with comprehensive privacy laws (including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, and others as they come into effect) have substantially similar rights to access, correct, delete, opt out of targeted advertising and sales, and appeal denials of requests. To exercise any of these rights, contact privacy@thevicesolution.com.

    12. Children's Privacy

    The Site and Services are not directed to children under 13 (or under 16 in the EEA/UK). We do not knowingly collect personal information from children. If we learn we have collected personal information from a child without verifiable parental consent, we will delete it. If you believe a child has provided information to us, contact privacy@thevicesolution.com.

    13. Do Not Track

    Some browsers send a "Do Not Track" (DNT) signal. There is no industry-standard for how to respond to DNT signals, and we currently do not respond to DNT. We do honor the Global Privacy Control (GPC) signal as described in Section 11.3.

    14. Third-Party Links and Services

    The Site may link to third-party websites, plugins, or services that we do not control. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you use.

    15. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last Updated" date at the top, post the new version on the Site, and — where required by law — notify you by email or another reasonable means. Your continued use of the Site after the changes take effect constitutes acceptance of the updated Policy.
